    Section 6: Registration Contact & Terms & Conditions

    1. DURATION OF REGISTRATION CONTRACT

      This registration contract, concluded between NewBridge Graduate Institute (Pty) Ltd, (hereafter “NewBridge Graduate Institute”/“NGI”) and the Student and Principal Payer (hereafter “the Student”), applies only to the current academic year. Academic full year intake is from January to December of the same year, and mid-year intake is normally from July to June of the following year. For the purposes of this contract, the term ‘programme’ is used for all courses of study including qualifications and vendor or other courses of study.

      IMPORTANT

      It must be noted that NewBridge Graduate Institute offers both registered and accredited qualifications and offers courses of study that are sometimes of a more limited duration and intended to advance specific skills without resulting in a qualification. The onus is on the Student to establish whether their chosen course of study meets their requirements and what its registration and accreditation status is.

      Please also note that NewBridge Graduate Institute has both campuses and Hybrid Learning Campuses (HLCs). Our campuses are registered sites of delivery, while at our Hybrid Learning Campuses, you will receive the same level of support and guidance as you study towards your chosen programme.

      CANCELLATION

      In the event of any cancellation of this contract after the 1st day of the commencement of the formal programme you will become liable for the full programme fees applicable in terms of this contract. Should you cancel this contract before the commencement of lectures, you will be liable for the registration fee and full deposit amount, irrespective of when you cancel. If you have been awarded and accepted a bursary, the bursary will be revoked on cancellation of this contract, and you will become liable for the full programme fees.

    2. QUALIFICATION AND PROGRAMME INFORMATION

      1. REGISTRATION AND ACCREDITATION

        NewBridge Graduate Institute is registered with the Department of Higher Education and Training (DHET) as a private higher education institution under the Higher Education Act, No. 101 of 1997, Registration: 2001/HE07/003

        NewBridge Graduate Institute offers accredited qualifications and part qualifications associated with these registration statuses, which are recorded on its certificates of registration. NewBridge Graduate Institute also offers courses that do not lead to formal qualifications but may lead to other forms of recognition such as vendor certification. By signing this form, the Student acknowledges that:

        a) they know and understand the registration and accreditation status of the institution as detailed above;

        b) they know and understand the registration and accreditation status of the programme they have selected including whether or not the programme is a qualification;

        c) they have noted the SAQA identity number of the qualification they have registered for, where relevant, and understand the status of the qualification, including its NQF level and minimum and maximum duration;

        d) the advice on the programmes is available from the campuses and detailed information is in the Prospectus;

        e) they have selected the correct programme on the form;

        f) they agree to be bound by the rules, policies, and contracts, including the cancellation penalties.

      2. PROGRAMME CHANGES

        NewBridge Graduate Institute shall have the right to make changes to the programme curriculum, assessments campus offerings and course material at any time, without prior notification and without furnishing reasons. Changes will be communicated on the website or through written communication to the Student as soon as the changes have been approved by institutional structures.

      3. TRANSFER TO ANOTHER PROGRAMME AND ACADEMIC MATERIAL

        If the Student wishes to transfer from one programme to another, the Student must apply to do so within the first 7 days after classes commence. This transfer cannot be guaranteed as available space, class size and the programme schedule may make the transfer impossible. The student is responsible for the purchase of their own academic materials and any other costs for any programme into which they register and will not be refunded for any costs associated with the original programme.

      4. ACADEMIC CREDIT: ACCUMULATION AND TRANSFER

        NewBridge Graduate Institute may, at its discretion and in line with regulation, exempt the Student from one or more courses, assess the prior learning of the Student for such exemption, or give the Student credit towards a qualification after timeous presentation of the relevant evidence. Exemptions and credit transfers are limited to those credits / learning units from equivalent registered and accredited qualifications and can constitute no more than 50% of the qualification into which the Student is transferring or for which the Student is registering and can be no more than 50% of the credits of a completed qualification. The Student understands that this process is not automatic and requires an assessment of the comparability of the learning presented for this exemption or credit recognition. Further information is obtainable from the Manager of Academic Development and Student Support at the NewBridge Graduate Institute Head Office.

      5. ADMISSIONS AND ALTERNATIVE ADMISSIONS

        A Student will only be admitted to a qualification for which they have met the admission requirements unless they qualify for Recognition of Prior Learning, Mature Age Exemption, or another formal alternative admission. A Student erroneously admitted to a qualification or programme will be required to deregister and register in an alternative qualification.

      6. DELIVERY AND ATTENDANCE

        NewBridge Graduate Institute is largely a contact institution, although hybrid and remote teaching are incorporated into its model of teaching and learning in line with national regulatory requirements. The Student must establish the teaching method being used for the programme of choice prior to registration and certifies by signing this agreement that they are able to fully participate in the programme of choice and its delivery method. The timetable and commencement and assessment dates may be changed after written notice to the Student and/or on NewBridge Graduate Institute’s website.

    3. DURATION OF STUDY

      The minimum duration/completion time of a qualification or programme is provided to students. Students normally have no more than double that time to complete their programmes or qualifications.

    4. FEES

      1. REGISTRATION FEES PAYABLE (NON-REFUNDABLE)

        The relevant fees must be paid prior to processing of applications and registrations. Registration is not complete until the Student has provided evidence of having met the entry requirements, provided all required documentation, and made the relevant payments.

      2. PROGRAMME FEES, DEPOSITS AND ADDITIONAL COSTS

        a) Fees are communicated on the fee schedule.

        b) Programme fees consist of the tuition fees and any additional compulsory costs which must be paid to NewBridge Graduate Institute.

        c) Unless fees are paid in full before the start of the academic year, a deposit is payable in the amount published for the respective programme on the fee schedule. The Student's registration will not be finalised and the Student will not be allowed to start the academic year until the deposit is paid or the fees are paid in full.

        d) Students may be liable for certain other costs which may include, but are not limited to, appropriate uniforms or equipment, some academic material, practical and workplace based learning or excursions.

        e) It is the Student’s responsibility to purchase their own textbooks OR material where relevant from suggested suppliers or other suppliers and these costs are compulsory for the Student to have a reasonable chance of success.

        f) NewBridge Graduate Institute may amend the additional fees if it incurs additional costs for the additional charges, for example, due to the exchange rate or petrol prices.

        g) Where a student's fees are in arrears and/or where the required additional fees have not been paid, the Student may not be permitted to go on excursions, nor will they receive additional items linked to the programme.

        h) NewBridge Graduate Institute charges an annual fee.

        i) If a student needs to repeat a subject, the tuition fee for the subject is included in the year fee and the Student is only liable for an administration fee of R950 per subject repeated and any additional costs for that repeated subject, such as tours and excursions, that are not part of the annual tuition fee.

      3. FEE LIABILITY
        a) No student will be allowed to commence their programme if the applicable financial commitments have not been met.

        b) No student will be allowed to re-register or continue a programme or write an assessment and will not receive a transcript or statement of results, or be allowed to participate in graduation, unless all the programme fees of the relevant year are settled in full when due.

        c) In an academic year, students may be denied access to the campus, online learning platforms and participation in certain activities, should fees not be up to date before the commencement of any semester.

        d) No concession, relaxation or indulgence granted by NGI in terms of this section shall be deemed to be a waiver of any of NGI’s rights in terms of this section, or any other.

      4. OTHER FEES AND COSTS
        a) Students are also informed of additional voluntary costs, such as external certifications or optional excursions, which while not compulsory are highly recommended for their ability to add value and depth to the learning experience.

        b) Participation in activities and experiences in this category is not permitted for students who have not paid for these and is not permitted for any student in arrears on their compulsory payments.

      5. EARLY REGISTRATION DISCOUNTS

        Only advertised early enrolment discounts will apply and only if the institution receives the required funds by the advertised date.

      6. DISCIPLINARY ACTION

        The Student accepts that if they are not permitted to continue with their programme temporarily or permanently due to an adverse disciplinary outcome their liability for fees is not reduced. The Student agrees to the code of conduct by signing this agreement.

      7. COLLECTION FEES

        If legal action must be instigated for the collection of any outstanding fees, the attorneys involved will charge collection fees in this regard from the principal payer.

      8. BURSARY TERMS AND CONDITIONS

        Students are required to meet the conditions of this contract as well as of their bursary terms and conditions where relevant to be considered to be in good standing relative to this agreement.

    5. TERMINATION OF CONTRACT

      The Student is granted a 7-day cooling-off period from the registration date to cancel their registration.

      1. CANCELLATION OF REGISTRATION BEFORE COMMENCEMENT DATE OF STUDIES

        If a written cancellation (including completed NGI cancellation document) is received on or before the commencement date of the formal programme, the full registration fee and deposit will be held as a cancellation fee.

      2. CANCELLATION DUE TO FAILING GRADE 12/SENIOR CERTIFICATE (WHERE APPLICABLE)

        If a student provides proof of not having passed their Grade 12 examinations or no longer meeting the entrance requirements and thus no longer being eligible to complete the programme of choice any fees received will be refunded, excluding non-refundable registration fees.

      3. CANCELLATION AFTER COMMENCEMENT DATE OF STUDIES

        The Student accepts that they are liable for the full annual tuition fee should they cancel their registration after the commencement date of the formal period or applicable cooling-off period.

      4. CANCELLATION IN WRITING

        A cancellation will only be accepted if done in writing and supported by the completed compulsory documentation, and it will not be in effect until formally accepted by the Financial Head of Department. Email may be sent in writing to the relevant campus principal for more information and to receive the required forms.

      5. EARLY EXIT FROM THE COURSE OR ABSCONDING AFTER STUDENT COMMENCED WITH CLASSES

        No qualification or certification is issued if the course of study is not completed. No fee remission is given if the programme or part of the programme to which this contract applies is not completed. Students remain liable for the full costs associated with this contract, for the rest of the academic year. The only exception to this clause is the death of the Student.

      6. POSTPONEMENT OF STUDIES

        Students may, instead of cancelling, postpone their studies to the following year, any fees, if paid in full, will be carried over for them to the following year.

    6. INDEMNITY

      The Student acknowledges that they may be exposed to risks including but not limited to orientation, workshops, training, practical work, experiential learning, work integrated learning, field trips, camps, physical sport activities, travelling, social activities, use of campus facilities etc. By signing this contract, the Student waives all claims against NewBridge Graduate Institute’s owners and employees for any loss or damages suffered while the Student is, or as the result of being, a Student of this Institution resulting in death or loss or any harm or injury or illness suffered by the Student or any other person. Such consequences include any loss, destruction of or damage to any property belonging to the Student or any other person howsoever the damage or loss is caused by, but is not limited to, the negligence of NewBridge Graduate Institute or any official employee or representative of NewBridge Graduate Institute.

    7. PARTICIPATION IN ACTIVITIES

      By signing this form, the Student agrees to participate in all formal activities associated with the academic programme. Participation in any other activities including induction or social events is voluntary. The fire drill at the campus building is compulsory.

    8. DECLARATION

      The Student understands, accepts, and agrees:

      1. that NewBridge Graduate Institute shall have the right to summarily terminate the Student’s programme contract and expel the Student from NewBridge Graduate Institute should the Student breach any aforesaid undertakings or because of disciplinary action taken. The Student understands that such termination does not remove liability for the fees.

      2. that NewBridge Graduate Institute collects, processes and stores their personal information for the sole purpose of delivering on this contract and that this collection, processing and storage takes place in line with the relevant legislative requirements including the Protection of Personal Information legislation.

      3. that pictures taken of them participating in NewBridge Graduate Institute activities may be taken and may be used for marketing or academic assessment purposes.

      4. that they are fully aware of all the financial obligations regarding the programme that the Student is going to follow and accept full responsibility for the settlement thereof. In terms of the National Credit Act No. 34 of 2005, the undersigned acknowledge that they have the financial ability to comply with this credit obligation as set out in the fee schedule and any third-party payer agreement that may apply and that it is within their payment ability.

      5. to give permission to NewBridge Graduate Institute officials to do the necessary credit checks for credit arrangements.

      6. that the information in this application form/registration contract is complete and correct.

      7. to comply with all the rules and regulations, including the disciplinary rules and any amendments thereof as published from time to time and to acquaint themselves with all the provisions thereof.

      8. that they have studied the tuition fees and accepts these fees and the terms and conditions thereof.

      9. that personal and academic information may be shared between NewBridge Graduate Institute, the Student, and the Principal Payer.

    9. SURETY

      The signatories bind themselves, jointly and severally, as co-sureties and co-principal debtors for the payment of all fees and other charges due to NewBridge Graduate Institute in terms of this contract.

      Where a third party such as a co-payer, trust, or company, must be invoiced for the fees, this will only be done if a relevant third-party agreement is signed and appended to the agreement failing which the original signatories remain fully bound by the agreement.

    10. DOMICILIUM CITANDI ET EXECUTANDI

      The parties consent to the jurisdiction of the Magistrate’s Courts, in respect of any legal proceedings that may be instituted arising from or in respect of the contract, notwithstanding the fact that the amount in dispute may exceed the jurisdiction of the Magistrate’s Court. In this regard the parties choose as their domicilium citandi et executandi for all purposes their physical addresses included in this contract.

    11. GENERAL

      No concession, relaxation or indulgence granted by either of the parties to the other party shall be deemed to be a waiver of any of that party’s rights in terms hereof, nor shall any relaxation or indulgence be deemed to be a notation of any of the terms and conditions of this contract. This contract shall constitute the whole agreement between the parties, and no amendment or agreed upon cancellation thereof shall bind the parties unless put in writing and signed by both parties.

      Legal costs to be awarded to any party to this contract in the event of legal proceedings in respect of a cause of action arising from this contract, will be calculated on the attorney and client scale of fees and will include collection and tracing charges in enforcing the obligations of any of the parties to this agreement.
