Commercial Legislation develops students’ fundamental knowledge of the legislation and regulations that apply to everyday commercial transactions. Students will explore the basic principles of contract law, possible remedies for breach of contract, and the influence of the Consumer Protection Act and National Credit Act on commercial activity and marketing.
The module also introduces students to competition law and different business forms, including partnerships, close corporations and companies. As a compulsory module shared across the BCom qualification family, Commercial Legislation gives commerce students critical legal knowledge that supports responsible decision-making in business contexts.
IN THE DEGREE
This is a compulsory module shared across the Bachelor of Commerce in Accounting, Bachelor of Commerce in Marketing and Bachelor of Commerce qualifications but does not have to be completed before curriculum stream decisions are made. Completion of this module in the B Com curriculum if that is the route you have chosen will enable you to make a decision between Commercial Law and ICT in Business as an area of focus in that degree.
Through an introduction to commercial law, commerce students gain critical skills and knowledge that support their understanding of business, marketing and commercial transactions.By introducing students to contract law, consumer protection, credit legislation, competition law and business forms, the module helps them understand the legal environment in which businesses operate and prepares them to approach commercial decisions with greater confidence.
By the end of this module, students will be able to:
- Master the ability to perform marketing roles while complying with commercial legislation.
- Understand the basic principles of the law of contract and apply these principles in a factual setting.
- Master the ability to advise about possible remedies for a breach of contract in factual settings.
- Understand how the Consumer Protection Act and the National Credit Act influence commercial transactions and marketing.
- Understand the concept of competition law and how it applies to marketing.
- Understand the different business forms and distinguish between them.
- Develop a well-rounded understanding of the nature and operation of partnerships, close corporations, and companies.
